That was a hate crime. Two years ago I was shy to say it but now I am not afraid to say that it was a hate crime and racial profiling.
I was singled out and profiled because of the color of my skin. That was a racial harassment and deliberately done in the lobby where the public could see. I'm still experiencing anxiety from that incident.
Please re-read my complaint sent in May 2019 and below in January 2020.
Hate Crime Complaint
I was profiled, discriminated, insulted, and embarrassed by Lathrop Save Mart store employees. I was accused of stealing grocery items as I was leaving their store and with no one asking me for receipt or talking to me, they simply yanked my cart from behind. I think they thought I was a homeless person. That was so insulting and embarrassing that I could have had a heart attack at that moment or snapped back to the store employees.
Why didn’t they ask for receipt is beyond my understanding and Save Mart, after numerous request, would not provide explanation.
I immediately reported this incident to their corporate office and after talking to a manager in that the same spot where it happened, a week later they sent me a $50 gift card in the mail to my home address. I immediately returned the gift card because the letter did not include the sender or manager’s name and I am afraid if there is no monetary value and then I use it, that would be another embarrassing experience and they might call the police on me. If they were sincere, they could have handed that gift card to me at our meeting.
I filed a written complaint through the Lathrop Police Services but they would not escalate my complaint to the corporate level after the Lathrop store manager informed them to call their corporate lawyers.
I then filed a complaint though the District Attorney Office (Stephen Maier) but I was informed that while they agreed on the obnoxious behavior of the store employees on what they did to me, there is no crime to press charges and is also a “threat” to even reach out to Save Mart’s corporate office.
I have filed the complaints in writing in order to document my experience. And as a law abiding citizen is to properly ask our local authorities to investigate and then press charges if necessary against Save Mart because the incident took place in a marketplace where common goods are sold to the public for consumption on a daily basis. It did not happen in a specialty store or in a private place. All I am asking in my complaint is for Save Mart to offer an explanation as to why their employees did to me what they did to me. If they say it was an isolated incident, I am barely a 5’- 6” and 160 lbs. brown skin Filipino so are they saying they have not seen a Filipino before in Lathrop? I am suspecting that because of my clothing a pair of worn out jeans, gray t-shirt, and baseball cap that made me looked suspicious and homeless to them. But even if I were a homeless, they don't respect homeless? Where is the human kindness? And by the way, that was a Saturday afternoon and I just finished my yardwork at home before I went to Save Mart.
However I am more suspicious that I have been profiled by their use of surveillance cameras and facial recognition. I am suspicious that someone in their corporate office monitoring the cameras and directing the employees to pick on me. To me that need to be investigated because that violates my rights as a consuming public. That is a serious offense to me.
While I could not be more persuading to the Lathrop Police and the DA’s office to investigate Save Mart, I would like to at least receive a written narrative from both agencies. This was reported in April 2019 and since then I have not received any report from Lathrop Police. The Deputy DA, after talking to me on the phone twice, is hesitant to provide me a written narrative.
I am still upset over that experience that every time I go to the mall or supermarket I now have an anxiety. Anxiety because I am now afraid that something like that would happen again to me. Anxiety because I am now afraid that someone would yank me from behind for no reason. Anxiety because I am now afraid that I would get a heart attack or would not be able to control myself to strike back.
Basically I am now afraid and conscious to go to any supermarket because of that experience and that is not fair. Save Mart has since and is depriving me of my basic freedom.
